          NOTICE is hereby given that the Borough of Beachwood will receive competitive contracting proposals for its annual July 4, 2017 fireworks display on February 7, 2017   at 10:00 a.m. at the office of the Borough Clerk, 1600 Pinewald Road, Beachwood, New Jersey in accordance with the technical specifications on file with the Beachwood Borough Clerk and available for public inspections Monday through Friday, 8:30 a.m. to 4:00 p.m.

          All proposals shall be in accordance with the requirements of N.J.S.A. 10:5-31, et seq. and N.J.A.C. 17:27 and each competitive contractor shall submit a copy of its business registration certificate as issued by the State of New Jersey.  Bid packets are available on the Borough’s website at www.beachwoodusa.com under the Borough Legal Notices Tab.

NOTICE OF RESOLUTION 2017-01 PROFESSIONAL CONTRACTS BOROUGH OF BEACHWOOD BOROUGH, COUNTY OF OCEAN, STATE OF NEW JERSEY AUTHORIZING PROFESSIONAL SERVICES AGREEMENTS FOR THE YEAR 2017 UNDER THE FAIR AND OPEN PROCESS

WHEREAS, the Local Public Contracts Law N.J.S.A. 40A;11-1 et seq. requires that notice with respect to contracts for professional services awarded without competitive bids must be publicly advertised.

NOTICE OF RESOLUTION 2017-23

AUTHORIZING A SPECIALIZED FINANCIAL ADVISORY SERVICES GROUP FOR THE BOROUGH OF BEACHWOOD, COUNTY OF OCEAN, STATE OF NEW JERSEY

 

WHEREAS, there exists a need for specialized financial advisory services in connection with the issuance of bonds or notes of the Borough of Beachwood (the “Borough”) in the County of Ocean, State of New Jersey, including the planning and development of a financing strategy and structure, coordinating the financing process, providing consulting services through the actual execution of the financing and provide follow-up reporting and analyses after the transaction is complete, and

 

WHEREAS, such specialized financial advisory services can be provided by Phoenix Advisors, LLC, a financial advisory group of Bordentown, New Jersey, so recognized by the financial community; and

 

WHEREAS, the Local Public contracts Law (N.J.S.A. 40A:11-1 et seq.) requires that notice with respect to contracts for Professional Services awarded without competitive bids must be publicly advertised;

NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Beachwood as follows:

 

(1)           The financial advisory group of Phoenix Advisors, LLC of Bordentown, New Jersey, is hereby retained for 2017 to provide the specialized financial advisory services necessary in connection with the issuance of bonds or notes by the Borough not to exceed $17,500.

 

(2)           The Contract is awarded without competitive bidding as a “Professional Service” in accordance with the Local Public Contracts Law; N.J.S.A. 40A:11-5(1) (a), because it is for services performed by persons authorized by law to practice a recognized profession.

 

(3)           The Mayor and Clerk are hereby authorized and directed to execute an Agreement with Phoenix Advisors, LLC.

 (4)           A notice of this action shall be printed once in a Borough legal newspaper

Submission information is detailed in this notice. All submission packets must contain hourly rates and be clearly marked for the Professional Service under consideration.

Municipal Services Package Proposals are to be in duplicate. Please also include a proposed contract with your proposal. Proposals shall be submitted as one (1) original and one (1) copy of their proposal, of which one must be unbound for further copying (if necessary) and 1 cd; and

*Land Use Services Package will be two (2) Hard copies and eleven (11) cd’s .

All Professional Service contractors are required to comply with the requirements of 52:32-44 (Business Registration of Public Contractors), N.J.S.A. 10:5-1, et seq. and N.J.A.C. 17:27 et seq. (Contract Compliance and Equal Employment Opportunities in Public Contracts).

Submissions by corporations and partnerships shall include a completed disclosure of ownership form (N.J.S.A. 52:25-24.2) and a non-collusion affidavit.

The Borough Council reserves the right to reject any and all submissions due to any defects or waive informalities and accept any submissions that in their judgment will be in the best interest of the Borough. The Borough Council shall award the contract or reject any and all submissions no at their annual re-organization which will be held on January 6th, 2017. All Professional Proposals not awarded will be kept on file and considered for any special project to be addressed in the 2017 Calendar Year.

NOTICE OF SALE OF MUNICIPAL LANDS

 

NOTICE IS HEREBY GIVEN that pursuant to Resolution No. 2014-105 heretofore passed by the Borough Council of the Borough of Beachwood, the Borough will offer at public auction sale to be held on April 1, 2014 at 6:30 p.m. at the Beachwood Municipal Complex, 1600 Pinewald Road, Beachwood, New Jersey to the highest bidder, under the terms and conditions hereinafter stated, all the right, title and interest of the Borough of Beachwood, if any, in the lands and premises known and designed in Schedule �A�, which is annexed hereto and made a part hereof, wherein said lands and premises are described by reference to lot and block on the Tax Map of the Borough of Beachwood. Said map is available for inspection by the general public in the Borough Clerk�s Office, 1600 Pinewald Road, Beachwood, New Jersey.

The terms and conditions under which said lands will be sold are specifically set forth in Resolution No. 2014-105 and are as follows:

A. A minimum sale price is set forth on Schedule A attached hereto and has been established by the governing body of the Borough of Beachwood. Upon the completion of the bidding, the highest bid may be accepted and all the bids, including the highest bid, may be rejected by the Borough Council.

B. The date of said sale shall be April 1, 2014 at 6:30 p.m. and the place shall be the Beachwood Municipal Complex, 1600 Pinewald Road, Beachwood, New Jersey.

C. The sale and conveyance hereunder shall be subject to all covenants, easements and restrictions whether of record or not, as well as subject to all presently existing municipal rules, regulations and ordinances, including the zoning ordinance and amendments thereto of the Borough of Beachwood. The sale of any parcels shall in no way bind the Borough of Beachwood to make any improvements, to provide access, or to improve presently existing accesses, whether they be by public road or not, nor is there any representation in fact that access does exist to any of the parcels named therein. The sale shall in no way bind the Borough of Beachwood to bring utilities to the property in question. All costs regarding utilities shall be borne by the developer.

D. The form of conveyance of said lands by the Borough shall be a standard form of municipal Quitclaim Deed. The right to reject any and all bids, including the highest bid, is reserved. If the purchaser shall present Title Insurance Binder to the Borough of Beachwood showing good and marketable title in the Borough, then the Borough shall convey to the purchaser in a Bargain and Sale Deed with Covenant vs. Grantors Act.

E. At least 10% of the amount bid shall be paid by the successful bidder at the close of bidding, which may be by personal check. The balance of the bid price or purchase price shall be in cash, certified or bank official's check, payable at time of transfer of title, but in no event later than sixty (60) days after the date of the land sale. In the event the Borough Attorney certifies to the Borough Council that questions of title exist, in that event payment shall be made within 150 days after the date of land sale, -unless further extended by resolution of the governing body.

F. In the event the purchaser shall fail to pay the balance due as herein provided, the payment made at the time of the public auction shall be retained by the Borough as liquidated damages for the non-performance of the bidder. G. No representation is made by the Borough as to the marketability or insurability to title to any parcel. In the event that the title of the Borough to any parcel or portion thereof is not marketable or insurable at regular rates by a reputable title insurance company licensed to do business in the State of New Jersey, a successful bidder's sole remedy shall be the right to demand the return of any deposit paid to the Borough.

H. The Borough shall include a restriction in said deed of conveyance that the undersized lot being conveyed must be consolidated with the property of the successful contiguous bidder.

I. The successful bidder shall be responsible to pay the administrative fee of $100.00 towards the sale, a $600.00 attorney fee to the Borough Attorneys and recording fees. If bidder requires a title search, survey, etc., they shall obtain the same at their own expense.

    LEGAL NOTICE

    THE BOROUGH OF BEACHWOOD is seeking proposals from respondents that are Registered Municipal Accountants in the State of New Jersey and have the experience and knowledge to provide Municipal accounting services to prepare the 2013 Municipal Audit for the Borough of Beachwood, and the required related accounting services.

    Firms and/or persons responding to this RFP shall be able to demonstrate that they will have the continuing capability to perform the following services, if awarded a contract.

     SCOPE OF SERVICES

     The Independent Auditor shall audit the BOROUGHâ��s financial statements and related notes of the various finds for the year ending December 31, 2013 and all other related statements and supplementary schedules prepared in conformity with the Requirements of Audit as promulgated by the Division of Local Government Services, Department of Community Affairs, State of New Jersey (the â��Divisionâ��) for the year then ended, for the purpose of expressing an opinion on them as the whether the financial statements are fairly presented, in all material respects, in conformity with accounting practices prescribed by the Division which is a comprehensive basis of accounting other than accounting principals generally accepted in the United States of America.  The financial statements and related notes of the various funds and supplementary schedules will be provided to the Independent Auditor by the Fee Accountant appointed by the BOROUGH.

     The Independent Auditor shall conduct the audit in accordance with auditing standards generally accepted in the United States of America, Government Auditing Standards, issued by the Comptroller General of the United States and in compliance with the audit requirements prescribed by the Division.

     If applicable, the Independent Auditor will audit the BOROUGHâ��s compliance with the types of compliance requirements described in U.S. Office of Management and Budget (â��OMBâ��) Circular A-133 Compliance Supplement and the New Jersey State Aid/Grant Compliance Supplement that could have a direct and material effect of each of the BOROUGHâ��s major federal and state programs.  If applicable, the schedules of expenditures of federal and state awards will be subjected to auditing procedures applied in the audit of the financial statements.  If applicable, the schedules of expenditures of federal and state awards will provided to the Independent Auditor by the Fee Accountant appointed by the BOROUGH.      ORDINANCE OF THE BOROUGH OF BEACHWOOD, OCEAN COUNTY, NEW JERSEY AMENDING CHAPTER XV ENTITLED, "WATER" AS IT APPLIES TO WATER CONNECTION FEES

    BE IT ORDAINED by the Borough Council of the Borough of Beachwood, County of Ocean and State of New Jersey, as follows:

    SECTION 1. Section 15-1.9 of the Code of the Borough of Beachwood entitled, "Rates and Charges", is hereby amended and supplemented to include the following addition to Sub-section 15-1.9e:

    1. Each R.F.P. shall be submitted in writing, addressed to the Borough Clerk, Beachwood Municipal Complex, 1600 Pinewald Road, Beachwood, New Jersey 08722 and shall be in the hands of said Clerk at or before the time set forth in the Notice for the receipt of R.F.P. No responsibility shall be assumed by the Borough for any R.F.P. mailed to the Clerk which is not received by her before the time stated above for the receipt of R.F.P. No R.F.P.s will be received after the first one is opened at said time and place.
